Mortgage Financing
This is perhaps the most import part of a purchase and
sales agreement. This agreement may allow the buyer to avoid a
contract if significant efforts for financing are futile. This is
the reason why most real estate transactions fail, due to the
buyer's inability to get financing. This agreement would define
what would be constituted as a significant effort. If the buyer
does not make a good faith effort to obtain financing, then the
buyer is in default.
